1.1 Upon purchase of lottery ticket(s) from Afrihood.com you are consenting to abide by all the provisions detailed in this agreement between Afrihood and you (the Customer).
1.2 If any provision included in this agreement is not clear to you, we request that you first ask for clarification before transacting or ordering from us with respect to this lottery promotion.
2. Amendment of Terms
2.1 Afrihood may add, change or remove certain sections of this agreement at any time at its own discretion. All such changes made will immediately become effective on their publication on Afrihood’s website.
2.2 If you consider any amendments carried out to be intolerable, you may cease using the service.
3. Description of the Lottery Promotion
3.2 This lottery promo is geared towards the actualization of Afrihood’s vision to change the face of Africa (one building at a time).
3.3 The promo will run monthly and a winner will be announced at the end of each month. The funds to be generated from the lottery promotion each month shall be allotted as follows:
- 60% (Winner)
- 25% (Afrihood)
- 10% (Affiliates; entitled to a commission of N100 for every ticket purchased through their referrals)
- 5% (Affiliate through whom the winner joined)
3.4 The percentage of the fund derived from a month’s lottery promo allotted to a winner shall be applied towards the realization of any of the following options out of which a winner may elect one:
- Interior designs of winner’s rented or acquired space or property.
- Face-lift and Renovations of winner’s space or property (Interior and Exterior)
- Purchase of Real estate (Land and, Residential, Commercial or Industrial facilities)
- Rent payment (for residential, commercial or industrial use)
- Payment of utility bills.
- Supply of home appliances, office or industrial equipment.
- Supply of provisions and food items.
- Any other execution or installation that is real estate related or complements the use of real estate.
3.5 The winner(s) shall be announced at a public draw to be organized by Afrihood. The winner(s) will be contacted by Afrihood through mobile phone number or email address provided. Afrihood will contact such winner(s) at least twice a day over a period of one week from the day the result was announced, between the hours of 10am and 4pm. If a winner cannot be contacted during this period, he is disqualified and forfeits the prize.
3.6 If a winner forfeits the prize, the prize is deemed unclaimed and remains at the disposal of Afrihood.
3.7 The winner shall be interviewed to ascertain which of the options in 3.4 above, he/she chooses and Afrihood shall dispense the money towards the realization of that option.
3.8 No winner shall be entitled to receiving the cash equivalent of the agreed percentage allotted to winner(s).
3.9 A winner is at liberty to choose another option from those listed in 3.4 above, where it appears that his/her allotted percentage cut cannot take care of the cost of executing his/her initial option.
3.10 Winner(s) agree to the publication of their names and/or photographs in any media or promotional material produced by the Afrihood. Such use does not entitle the winner to any further compensation.
3.11 Affiliates shall be entitled to 10% of the total income derived from their referees and the affiliate through whom the winner joined shall be entitled to an additional 5% of the fund raised from the month’s lottery promo.
4. Procedures for handling your winnings
4.1 Upon emerging a winner at the draw, Afrihood will send you (winner) an official lottery claim form to be filled, signed and sent back to us. We will then use this form plus your ticket to process your winnings.
4.3 Afrihood shall be under no liability to pay any additional money in a situation whereby a winner’s agreed percentage cut cannot meet with the demands of executing his/her chosen option.
4.4 Any third-party costs incurred in the course of the winnings’ execution process including the transfer of monies to you and the handling of the winning ticket will be borne by you (customer).
4.5 The responsibility for reporting your income including the payment of taxes to the relevant Federal and local authorities in Nigeria as well as the State you reside in lies on you. Consenting to this agreement also means you acknowledge that Afrihood may on your behalf retain part of your winnings and directly forward it to the relevant tax authority.
4.6 If for some reason the third parties engaged by Afrihood to deliver/execute your winnings fail to do so, Afrihood will not shoulder any obligation to compensate you a corresponding amount. However, Afrihood will avail your winning ticket/official lottery claim form to you so that you can ensure compliance by such third party(ies) towards the execution of your winnings.
5. Purchase Terms
5.2 ELIGIBILITY: Afrihood requires that all users shall be 18 years of age and above. You are allowed to participate in the game if you are legally permitted to do so via the laws of your jurisdiction.
5.3 OWNERSHIP: As the customer, you are the lottery ticket sole owner and shall be entitled to any winnings which may arise from the tickets.
5.4 TRANSFER: You acknowledge that your tickets shall in no condition neither be transferred nor assigned to another party.
5.5 TAXES: As the customer, you are responsible for the payment of all relevant taxes associated with the income you receive from your lottery winnings.
5.6 CURRENCY: To the extent that we credit or debit you any amounts under these Terms, we will do so in the naira currency. Payments to Afrihood, maybe done with any currency applicable to your location and it will be converted to the designated currency (
N Nigerian Naira). We may charge a fee for such conversion and it is included in the transaction upon deposit. Note that as currency rates fluctuate globally, the exchange rates at Afrihood will be adjusted accordingly.
5.7 CHARGES AND CANCELLATIONS: The purchase of a lottery ticket from Afrihood is a direct authorization by you to impose charges to your credit card both for the ticket fees and any other goods or services pertaining to the site. Any purchase so made is non-refundable.
5.8 START OF PURCHASE: As soon as your payment is verified, an electronic ticket(s) shall be issued to you and your purchase will commence immediately. Our system endeavors to prevent you from participating in the lottery draw in case of miss matching the due date. Therefore, if you suddenly bought the ticket after the draw begins, you will be automatically forwarded to the next draw, if any.
5.9 COMMENCEMENT OF AGREEMENT: This agreement will take effect on the date you purchased a lottery ticket from Afrihood.
5.10 WINNINGS: All winnings will be processed as per the terms detailed in the ‘Description of the lottery promotion’ section above. Afrihood will expend every effort to avail the ultimate winner with the prize won.
5.11 ERRONEOUS INFORMATION: Afrihood will carefully record the winning number for all official lottery drawings. In the event wrong information is sent over to you, you reserve no right to any claim as shown by such erroneous information.
5.12 DISCLAIMER: Afrihood will not be liable for delay or failure in undertaking an obligation under this agreement such as executing winnings and issuing lottery tickets if it is prevented by causes beyond its control, including extreme weather, natural catastrophes, actions of lottery organizations or commissions, local and federal governments, slowdowns or transportation stoppages, computer viruses, war, network slowdown, or any reason deemed as beyond the control of the Afrihood and its employees or agents.
5.13 JURISDICTION: This agreement shall be governed by the laws and regulations of the Federal Republic of Nigeria.
5.14 SCOPE OF THE AGREEMENT: These terms and conditions including any future amendments or updates constitute the whole and entire agreement between Afrihood and any user registered to the site or taking part in the activities proposed by Afrihood. Any promise, presentation, consent or undertaking whether in writing or verbally which contravenes these terms and conditions will be null and void.
5.15 START OF SUBSCRIPTION: As soon as your payment is verified and your electronic ticket(s) is/are issued, your subscription will commence immediately.
5.16 REFUND POLICY: If Afrihood fails or is unable to fulfill an offer to purchase a ticket by issuing ticket(s) to a verified user for any reason whatsoever before the draw commences, the offer to purchase is void and a full refund will be made to the customer’s Afrihood’s account within 48 Hours.
6. Bonuses / Promotions and Rewards
6.1 We may make available on the website the bonus offers, promotions or reward programs. You can find more information on the website, in your Account or our help pages.
6.2 Your eligibility for the offer or promotion and/or participation in the rewards program will be subject to the terms and conditions for the respective bonus offer, promotion or rewards program available on the website at all times.
6.3 Afrihood reserves the right to deny admission or to terminate admission to any of the bonuses, promotions and/or special offerings, as well as to modify, suspend or discontinue their validity at its sole discretion and without informing the Customer.
7. Disclaimer and Limitation of Liability
7.1 The materials presented on this site are provided as they are and have no warranty either implied or expressed such as implied warranties of merchantability, non-infringement, and fitness for a certain purpose. Afrihood does not guarantee the completeness, usefulness or accuracy of any information on this site. Afrihood also, does not warrant that the information contained in materials available on the site or their functions are error-free or uninterruptible. The customer and not Afrihood, is responsible for the entire cost of all necessary repair, servicing, and correction.
7.2 Under no circumstances, will Afrihood assume liability for any consequential or special damages resulting from the inability to use or the use of information presented on this site irrespective of whether Afrihood has been notified of the possibility of such damages or not. Afrihood’s total liability including losses, damages, and causes of action will in no event exceed the amount the customer paid to Afrihood in the course of your last subscription for products or services purchased on this site.
7.3 Afrihood shall not be held liable under any circumstances including negligence for the settlement of a lottery’s jackpot.
7.4 Each of the customer’s lottery participation is purely voluntary and done at the customer’s own risk. In case of any dispute with any other third party with regards to a lottery draw, you agree that Afrihood will not be held accountable for any damages or claims arising from such a dispute. Afrihood reserves the right but not an obligation to monitor such disputes.
7.5 Except otherwise stated, Afrihood does not make any warranties, representations or conditions either implied or express as to the safety of the information the customer provides or the activities the customer participates in during his/her use of the site.
7.6 No applicable law may allow for the exclusion of the above limitations of liability or implied warranties.
8. Complaints and Suggestions
8.1 If you wish to make a complaint or a suggestion regarding Afrihood, the Website or the services offered, as a first step you should contact our Legal/Admin or send us an email through [email protected]. As a second step, the complaint shall be assigned to an advisor that will provide you with the appropriate response. Save as provided further under clause 8.3, should the complaint not be resolved as expected by you, a response shall be provided to you through internal message or email by the Legal/Admin Manager who will report the final decision to you.
8.2 All claims and suggestions should be forwarded to the Customer Service in a written form via internal message, fax, mail or e-mail. No complaints with regard to the acceptance, settlement or resettlement of a ticket purchase will be heard by us if they are not raised through our Legal/Admin within 7 days from the occurrence of the event from which the complaint arises.
8.3 Offensive or rude language, as well as malicious or damaging comments, will not be tolerated while contacting our staff or while discussing our products and services in any media, social network or forum. Any infringement of this policy will result in a suspension of the Account or in every additional action as may be required in order to ensure compliance.
8.4 A Complainant shall first explore the dispute resolution means provided under clause 8.1 above before resorting to the regular courts or other tribunals.
9. Responsible Gambling Policy
9.1 Afrihood encourages responsible attitudes and approaches towards gambling. In this regard, we prohibit any person less than 18 years of age from participating or registering an account with us.
9.2 We also recommend that all users limit their lottery draws participation and not entirely depend on the lottery as a source of income. In the event you strongly feel your usage of our services amounts to irresponsibility, we encourage that you review your participation before proceeding.
10.2 In such instances, the part declared invalid or unenforceable shall be amended in a manner consistent with the applicable law to reflect, as closely as possible, Afrihood’s original intent.
Afrihood shall have the right to accepting any offer for purchase of lottery ticket(s), temporary to suspend or permanently to terminate the provisions of lottery services to a user without providing any reason.
